For clients who want a more efficient and less expensive Collaborative Divorce process, a few steps are helpful.
Aim for flexibility, ‘see both sides’, keep an open mind, and be ready to compromise. Rigidity can generate delays and escalate costs.
Know your own and the other person’s broad goals and interests. If one person wants adventure and the other wants security, keep these themes in mind when exploring possible solutions.
Negotiation must wait until financial paperwork is completed, including documentation, a budget and a net worth statement. Getting this done on time is an easy way to save time and money.
If strong feelings are getting in the way, get help from a facilitator to work these through in order to be calmer, clearer and wiser in the process and to reach compromise more quickly.
Accomplishing some of the Collaborative Divorce work with a neutral, when appropriate, can be cost-saving because of their lower fees.
Homework for clients is assigned regularly throughout the Collaborative Divorce process. Completing this before the next meeting improves efficiency.
Don’t negotiate major matters on your own as this usually creates more problems than it solves.
If your issue is best addressed by a neutral, speak to a neutral. If you have a legal question, speak to your lawyer.
Don’t presume what should happen—for oneself and for the other person. Be patient and receptive so that better, more creative options can emerge.
